Welcome to Kimber Accounting. These Terms and Conditions (“Terms”) govern your access to and use of KimberAccounting.com, including its webpages, forms, resources, client-access links, and other website features (collectively, the “Site”).

In these Terms, “Kimber Accounting,” “we,” “us,” and “our” refer to Kimber Group, Inc., doing business as Kimber Accounting.

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Professional services provided by Kimber Accounting may also be governed by a separate engagement letter, proposal, statement of work, or service agreement.

1. Acceptance and Permitted Use

You may use the Site only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Attempt to gain unauthorized access to the Site, client portals, servers, accounts, or systems.

Unless provided as part of a formal professional engagement, Site content should not be considered individualized:

Nothing in this section prevents Kimber Accounting from providing individualized bookkeeping, accounting, tax, financial reporting, fractional CFO, or related services under a formal client engagement.

3. No Professional-Client Relationship From Website Use

Using the Site does not automatically create an accountant-client, tax-professional/client, fiduciary, advisory, or other professional relationship with Kimber Accounting.

A professional relationship is not created merely because you:

  • Visit the Site.

  • Read Site content.

  • Submit a contact or intake form.

  • Complete a questionnaire.

  • Send an email or inquiry.

  • Interact with an automated chatbot.

  • Request information.

  • Schedule or participate in an introductory consultation.

A professional engagement generally begins only after Kimber Accounting accepts the engagement and any required engagement letter, proposal, service agreement, or other written agreement is accepted or executed.

Until an engagement is established, you should not assume Kimber Accounting is monitoring tax deadlines, filings, payments, financial transactions, notices, or other obligations on your behalf.

4. Professional Services and Client Agreements

Kimber Accounting may provide services including bookkeeping, financial reporting, tax-related services, financial analysis, fractional CFO support, budgeting, cash-flow forecasting, and business planning.

The exact services provided to a client will be defined by the applicable engagement agreement.

A separate agreement may address:

  • Scope of services

  • Responsibilities

  • Deliverables

  • Fees and payment schedules

  • Cancellation or termination

  • Confidentiality

  • Document requirements

  • Limitations of responsibility

  • Other engagement-specific terms

If an applicable professional-services agreement conflicts with these Terms regarding services provided to a client, the professional-services agreement will control for those services.

5. Client Information and Responsibilities

Accurate financial and accounting work depends on receiving accurate, complete, and timely information.

Clients and prospective clients are responsible for providing information and documentation that is truthful, complete, and reasonably current.

This may include financial records, bank information, revenue and expense records, payroll information, tax documents, ownership information, receipts, and other requested materials.

Unless otherwise required by law or agreed in writing, Kimber Accounting may rely on information supplied by clients or authorized third parties without independently verifying every item.

You should promptly notify Kimber Accounting if previously supplied information is inaccurate, incomplete, or outdated.

Delays or errors in information provided by a client may affect the accuracy or timing of services.

6. No Guarantee of Financial or Tax Results

Kimber Accounting works to provide professional financial, accounting, and planning services; however, business and financial outcomes depend on many factors outside our control.

We do not guarantee any particular:

  • Tax savings or refund

  • Revenue or profit level

  • Business growth

  • Cash-flow result

  • Cost reduction

  • Financing approval

  • Investment result

  • Audit outcome

  • Tax-authority decision

  • Financial result

Financial forecasts, budgets, models, estimates, projections, and recommendations may rely on assumptions and information that can change over time.

Actual results may differ from projections.

Testimonials, case studies, examples, or descriptions of previous results represent individual circumstances and do not guarantee that another client will receive the same results.

7. Tax Information

Tax laws, regulations, filing requirements, deadlines, and interpretations may change and can vary depending on jurisdiction and individual circumstances.

General tax information available on the Site may not account for your specific:

  • Business structure

  • Filing status

  • Income

  • Deductions

  • Credits

  • Properties

  • Transactions

  • Federal, state, or local requirements

You should not make significant tax or financial decisions solely from general website content.

When Kimber Accounting is formally engaged to provide tax-related services, the scope of those services will be defined by the applicable engagement agreement.

Kimber Accounting may use third-party platforms for client portals, scheduling, accounting, document sharing, payments, communications, or other business functions.

Users are responsible for protecting their login credentials and should promptly report suspected unauthorized access.

Whenever available, clients should use the secure communication or document-transfer methods designated by Kimber Accounting when sending sensitive financial or identification information.

Third-party websites and services operate under their own terms, privacy policies, security practices, and availability standards.

Kimber Accounting does not control every aspect of third-party technology and cannot guarantee that any online platform will always be uninterrupted, error-free, or completely immune from cybersecurity risks.

The Site may also contain links to third-party websites or resources. Providing a link does not necessarily constitute endorsement of every statement, service, policy, or practice of that third party.

9. Intellectual Property

Unless otherwise stated, the Site and original materials made available by Kimber Accounting are owned by or licensed to Kimber Accounting and may be protected by applicable intellectual-property laws.

Personal information will also be handled in accordance with Kimber Accounting’s applicable Privacy Policy.

An unsolicited website inquiry or preliminary communication does not automatically create all confidentiality obligations associated with an established professional-client relationship.

Prospective clients should avoid submitting unnecessary highly sensitive information before a formal engagement has been established.

Nothing in these Terms limits confidentiality obligations Kimber Accounting is legally or contractually required to honor.

11. Pricing, Payments, Cancellations, and Refunds

Pricing for Kimber Accounting services may vary depending on the type, frequency, scope, and complexity of the services required.

Unless specifically published or agreed in writing, these Terms do not establish a universal:

  • Fee schedule

  • Payment schedule

  • Retainer requirement

  • Cancellation period

  • Refund policy

  • Subscription term

  • Automatic-renewal policy

The applicable proposal, invoice, engagement letter, or service agreement will govern fees, billing, cancellation, refunds, and other payment-related terms for a particular engagement.

12. Website Availability, Liability, and Governing Law

Kimber Accounting may update, modify, correct, suspend, or discontinue portions of the Site at any time.

We make reasonable efforts to provide useful and accurate information but do not guarantee that the Site will always be:

  • Available without interruption.

  • Completely error-free.

  • Fully current.

  • Compatible with every device or browser.

  • Free from every possible cybersecurity risk.

To the fullest extent permitted by applicable law, Kimber Accounting and its owners, employees, contractors, and agents will not be liable for indirect, incidental, special, punitive, or consequential damages arising solely from use of, inability to use, or reliance upon general information available through the Site.

This limitation does not exclude liability that cannot legally be excluded and does not override obligations Kimber Accounting expressly accepts under a separate professional-services agreement.

Unless a separate agreement provides otherwise, these Terms and disputes arising specifically from use of the Site will be governed by the laws of the Commonwealth of Pennsylvania, subject to applicable legal requirements.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

Kimber Accounting may update these Terms periodically. The updated version will display a revised Effective Date.

Continued use of the Site after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
